Joel Disini, DotPH CEO, speaks about the Versomina libel case

Things are heating up with the libel case. dotPH continues its fight for free speech as the court date steadily approaches. We at dotPH believe blogging provides a valuable and valid means of expression for those who have no other way of manifesting grievances.
We asked for your take on the issue. For those who came forward and gave their opinions, thank you. Now, Joel Disini, the guy behind i.ph, explains the company’s side, and what we can do to prevent an environment where expressing an opinion or dissent can be suppressed by means of threats, legal or not.
Here is what Mr. Disini has to say:
As some of you may know, a lawsuit has been filed by Versomina and Mr. Joel Aquino against dotPH due to posts made by a blogger - alimuom.i.ph on the i.ph Wordpress-powered blogging platform. dotPH only hosts and provides the blogging software, yet somehow, Mr. Aquino prefers to sue us rather than sue the blogger. This action has cost us a lot of time and money, and we’ve agonized over several weeks whether to do, as Mr Aquino wants - to shut down the blog - or to carry this fight all the way.
Certainly, a big problem is that I’m not familiar with the issues alimuom.i.ph has against Mr. Aquino and his string of companies - Netpros, Versomina, etc. From reading the blog, and various tidbits on the web, one gets that sense that the employees (and ex-employees) of Mr. Aquino’s compaines have some real problems, and that the blog alimuom.i.ph has been useful in informing new and prospective employees of Mr. Aquino what to watch out for.
So we’ve actually done much more than has been expected - I and members of my staff have actually appeared at the Pasig RTC, we’ve retained some very good lawyers to look into this case, and even met with Mr. Aquino and Jun Ventura in an attempt to sort this matter out.
I’ve noticed that some of the comments at alimuom have been way too crass - there is too much swearing, too much vulgarity. This actually benefits no one. To the outsider, it makes it seem that the employees/ex-employees of Mr. Aquino posting on alimuom are just as crass and vulgar as they paint Mr. Aquino to be. What is needed is rational discourse, where both sides can air their grievances in a manner where the blogosphere can weigh in, make an informed judgement, and suggest alternatives. Instead, it’s become a big Versomina-bashfest.
So it was with high hopes that I met with Mr. Aquino and suggested that, if he dropped his lawsuit, we would endeavor to keep the discussion on alimuom (and all other i.ph blogs) sane, civil, and rational. I didn’t want i.ph to become like Brian Gorrell’s blog, which has turned into one big DJ-Montano hatefest. I myself, many years ago, have been bashed around in the local press, and I wanted to impress upon Mr. Aquino, the importance of being able to air his side on his own blog, and the importance of getting Mr. Aquino’s detractors to not use vulgarities, but to instead focus on the issues.
Unfortunately, Mr. Aquino is not into rational discourse. Nor is he, in his own words, into freedom of speech. He boasts that he has shut down all the blogs and online forums that have spoken ill of himself and his many companies. I actually believe this, as I’ve seen the pain he’s caused Abe of Yugatech, and a private thread on Philweavers re Versomina/Netpros is now gone. It is my belief, at this point, that any kind of agreement between dotPH and Mr. Joel Aquino is not possible.
So here’s the deal. If you believe alimuom.i.ph is a useful blog, and that the author’s issues against Mr. Joel Aquino are true and legitimate, and that there are other people at Versomina/Netpros and Mr. Aquino’s other companies with similar problems, then PLEASE:
1) write about it. You can write about it in the comments field in alimuom.i.ph, or email it to the author (if you know his identity), or post on some other blog. Please try to avoid using vulgarity in your posts. I’m not saying that your posts have to be devoid of passion - but that you actually put down data and facts so that the public can better understand your situation. You don’t have to disclose your identity, but remember that it is easier for the public to believe you if the facts you state can be verified. Please do not paste the same story multiple times over the web; the more variety there is in the stories, the stronger is your case.
2) Place a link to your story on news.i.ph, so we can better monitor your posts.
This does several things:
1) It tells the judge that alimuom.i.ph serves an important need. That, contrary to Mr. Aquino’s claims, this is not just the work of a few irate emloyees, engaging in “cyber bullying”. That there are many employees and ex-employees with legitimate issues against Mr. Aquino, and that this forum serves to protect those who need to be aware of Mr. Aquino’s allegedly unsavory practices.
2) It tells me that this issue is worth fighting for. I’ve consulted with many many people - and believe me - no one believes that I should take up the cudgels for someone who hasn’t even bothered to contact us - despite our numerous attempts to reach out to the author of alimuom.i.ph.
3) Most importantly, it tells Mr. Aquino that his strategy of shutting down every blog that speaks ill of him or of his companies is just not feasible. It may be hard for you to believe, but I’m sure Mr. Aquino will one day see that this fight is futile, and his best strategy should be just to listen to what his employees are saying, make adjustments to the way he treats his employees, and explain his side via his own corporate blog.
Our next hearing is on February 5 at the Pasig RTC. If I don’t hear from anyone, then I can only assume that this issue is no longer important, and you will forgive me for taking down the blog alimuom.i.ph. We specifically created i.ph as anonymous domain for individuals, so that people can blog anonymously without fear of lawsuits from the powers that be.
Unfortunately, with all rights come responsibilities, and now it is the responsibility of alimuom.i.ph to prove (to the satisfaction of the Philippine courts) that his posts & approved comments are not disinformation.

Hi, if it’s any help to you… please check how many cases are filed against Joel Aquino in the Department of Labor.
His years of operations has always included at lot of “under-the-table” transactions. That is why he has the guts to say in your face all that he told you. Also per our last count he has more than 50 cases (and still counting) he opened in Pasig RTC against ex-employees.

The blog just disclose some of the MANY hocus pocus being conducted by the company. Having my share of experience out there, the person who should be filed a libel case is Mr. Joel Aquino and his henchmens.
Here are some of them.
1. Even if you resign orderly they will delay it or make sure youll just want to go AWOL.
2. Every Xmas season a lot of suspension MEMO will fly around the office.
3. Salaries are usually late.
4. Almost every year they have a new company name.
5. They force you to pay for your “Certificate Of Employment Document”.
6. Even if your out of the company they still follow you. Being a low profile for a year will help. They will file a case on you if they found out you were employed in another company.
7. They have a very strict Rules and Regulations making the working environment stressful.
We all feel victimized by this company.
Because of their management the employees only last for a year ( just finishng the contract ) or less.
I vote for the site to stay up. We want to warn new job seekers because there are a lot of better company to work on to. I also want to be updated what their next company name will be.

Most projects handled by that company are adult sites. They have been raided by the authorities before but corrupt as the are they we able to pay them off so they can resume the business.

I was one of the many victims/ex-emplyee of this guy. I wonder how he ever gets to sleep knowing that a lot of people are angry and wishing him the worst because of his wrong doings. All the post on the blog as well the ones above are true. We cannot just presnt more evidence due to the fact that he might pinpoint who we are and charge us with any lawsuit he can think of. We are or most of us just cant afford to get a good lawyer and fight till the end. I think that is also the main reason why he keeps on sueing people or ex-employees, because he knows we cant afford to get someone to defend us. Also, I dont think he will win. Its our right to freedom of speech. I ask my fellow ex-netpros or versomina to support this issue and the blog. Once it gets popular, it will be aired in major tv stations like tv patrol and 24 oras. Once it made it there, rest assured many politicians will look at it especially now that the election is coming, they will surely ride on the issue and hopefully we will get our slice for peace and finally shutdown this guy. Let all blog about it…if we can show some proofs much better but be very careful. Good luck to all of us.

closing that blogsite, i haven’t even read or visited it, means that you are submitting to the whims of a dictator.if there is something or somebody who ought to be shut down or put in prison, it should be people who terrorize others just because of the mere reason that they can.
haven’t we put a stop to this kid of oppression when people power rose into full bloom?

I believe Mr. JOEL E. AQUINO shoots his own foot this time. If this issues made it to the news he can say bye bye to his “monkey-dirty-business” and i believe the fruit is ripe for the picking. But too bad bad grass really can’t that easily and you have to pick it from the roots. Numerous times of NBI checking up the office is already an evidence that it is not doing a clean business yet they still can get away with it. Based on what i read on the article of Joel Denisi it’s like Mr. JEA wants to show who’s the boss. oh well i believe everyone has it’s match, there is strength in numbers and i hope Mr. JEA won’t underestimate that. I support Alimuom and every great company should withstand detractors, i never knew “balat sibuyas” pala si JEA. can’t help but to be rude when we think of the past.

Kada taon may bagong contract na iba dun sa una mong pinirmahan at pag di mo pinirmahan yung bago i aAWOL ka para wala ka makuha sa kanila like yung cash bond n 10K. The truth about this company is that not only Mr. Joel Aquino does the dirty work but also his so-called followers. What makes the employees and ex-employees of Versomina so angry is that they were treated as if they don’t own their lives inside that company. Why do I know about this? ‘Cause I’ve been there… I’ve seen and felt how the management works. It’s not just about our taxes, sss, pag-ibig and philhealth, those are just money, it’s out dignity being stepped on each day we come to work by those in higher positions. I left that company and got better job somewhere else, where my employer can appreciate me even with just the little things I do. I may not be one of the smartest IT professionals out there, but I do deserve some respect… and I believe I’m not useless, ’cause I wouldn’t have gotten into a much better and high-paying company if don’t have the skills. Please don’t shut down the blog Alimuom, it gives job seekers info about the companies they should look out for and provides an outlet for those ex-employees who are in pain. The Idea of keeping the discussion on Alimuom sane, civil, and rational would be a much better decision, but shutting down the blog itself won’t stop employees and ex-employees of Versomia into creating another one. Mr. Joel E. Aquino, if you’re reading this, there are sever other blogs out there about your company. You may hide the truth by using your money, but you can never stop the cry for help and justice of those you and your company have caused great pain. BLOGS - it’s where we can only express ourselves freely, we all don’t have the amount of money that you have (to who ever you pay it for just to keep us quiet), but we have the freedom of speech… and that’s all we have (unfortunately)…

this i think is some of the reason why many people have hate related blogs against Mr. Joel Aquino’s company/s;
- there are no ITR’s (wala kasi pong bumabalik sa mga empleyado)
- SSS (madaming employees ang kulang ang bayad)
- stalking ex employess ( haha! eto totoo to, kahit di ka na empleyado, they know where you live and what is your current job is ~creepy)
- invasion of personal life ( kapag may kaibigan ka na ex employees or nag AWOL tapos nakipagkita ka sa kanila at nalaman nila, mainit ka sa mata nila. its either na maleyt ang sahod mu or pag nagkamali ka ng kaunti puro memo aabutin mo.. )

It seems to me that a rational discourse is indeed out of the question; it will only fall into Mr. Aquino’s deaf ears.. That’s an understatement already. Anyway, I don’t believe that irate ex-employees are to blame. What happened to freedom of speech and expression? The freedom to speak without censorship or limitation? What Mr Aquino is trying to do, I think, is censorship. Censorship in every sense of the word.
I am a former employee of Netpros. Heck..Crappy office rules, stupid regulations, and brutish office personnels disguised as human beings. Discontent with the company is evident among us so don’t blame us if we’re raising our fists in the air. We have every right to do so.
I have never heard of this NetPros company, but I have read the blog. Apart from the comments on the message board, there is nothing wrong with the contents of the blog. Each entry is nicely written, and the readers are obviously very mad at him. I looked at this guy’s picture and he surely doesn’t look nice.
I’m just a bystander but my strong opinion is: the blog should continue. Remove the message board and whoever is blogging here, should continue to do so. The Philippines is already in a bad state without these kinds of people.
one question to all employees: why dont you all file a case against this company and leave theM? I’m TRYING to setup an outsourcing company which will allow you to work from home, and its due for operations soon. I will not post the URL here because this is not about marketing. anyway, my point is, you have a right, why dont you start exercising them? it’s legal to have a union. you can even shut down his operations!

AQUINO. He has been a very selfish man. He doesn’t know how to take care of his people and all he cares about is how he will profit. There are no other good words to describe him. He’s business is a phony fake. Why do you think this company always changes it’s name? There has been almost 10 names (more or less). Why is this so? Is that legal? I bet not.
Anyway, for all the blogs that’s been circulating all over the net, they are all true. This is one company you should be avoiding. If you are a fresh graduate, you may just find a company that will help you grow more as a person and not to experience such things.

I hope Joel and his whole family stops doing these things to innocent people. To people who wants a decent job, who works hard and deserves to be treated fairly. “You just can’t let anyone stop giving comments, posts, and facts about your company, because we have the freedom of speech in this world.
I think you’re old enough to understand that, and I think it’s time to act as one. Treat your employees like a member of your extended family and stop controlling them as if they are one of your servants in your home. Work is work, you just can’t control your employees’ decision because they are old enough to decide what is good or what is not.
If you still want to keep your reputation as a good outsourcing company, be one of them and act like one. You may request us to shut down all the sites, blogs, or any other references that may describe your company, but it’s our decision whether we like to do it or not”

I worked in this company for almost 1 and a half year and I thought that my benefit was in good terms, but I didn’t expect that I don’t have a TIN number.. so I was thinking where does my bucks go? At the company’s name? Which account? Jea’s account? Duh o_O
I was one of those employees they forced leave.. and when they did get me back to work they give me only half of my salary.. they said that it was part of the salary deduction but it was not written on my pay slip.
Lastly they should not invade their employees personal life. They made a gossip out of it. Is that how professional people act? They should know their borders.

Alimuom must stay.. people has the freedom to express what he/she has experienced. And this will benefits other people to learn what is good and bad. Thank you for the information. ^_^ more power
I don’t think it’s a good idea to shut down the blog. First of all many ex-employees posted comment because they want to express what they feel and experienced from this company. Why would they consume time just say something thats not true. I was also from this company and I also didn’t liked the way they treated their employees. If your late for 30 minutes then your work for that day is not paid. Mr. Aquino should change the way he treated his employees so that he could receive the respect what he want. If he treated his employees just like the way he treated his clients, I don’t think that this would happen.
The latest thing about this company before I left them e gnwa ng NET na ang sweldo ng mga employee nila.. They said di na daw magbabayad ng tax ang mga employee ( which I think na mali and against the law) but they said na babayaran naman DAW ung SSS, pag-ibig at filhealth ng mga employees.

You are promised with a training, only to find out that there is none.
You are subjected to a large amount of bond, given that there is no training.
They don’t pay their employees SSS, Philhealth and TAX duties completely.
They don’t provide a signed payslip .
They don’t provide a company ID.
You cannot use your vacation and sick leave.
You get suspended for everything, even going to province on a holiday.
You get double deductions when you absent.
You will be not be paid for the day if you are late.
The list goes on.

He has sooo many pending cases sa DOLE. Tama yung mga sinasabi nung mga nagcomment. If he wants to shut down the blog dito by Alimuom, ibig sabihin guilty sya. The blog just expresses how the employees and ex-employees feels they way he is treating them sa under his management. Freedom of speech for godsakes…Ayaw nyang pakinggan yung mga employees nya, naghanap ng ibang alternative na pagbuhusan ng sama ng loob yung employee nya then he wants to shut it down?? He doesn’t own any of them so they have the rights to express what they feel. There is nothing wrong with that. Merong sariling forum yung netpros dati pero pinasarado din nya because of the complaints against him. Ayaw nya yata makita at marinig yung mga effect ng pinagagagawa nya. And besides, ninakaw lang naman nya yung company from his former partner kaya cguro takot na takot lumabas ang baho nya kya pigil na pigil sya tsk tsk….
I think Netpros has been raided many many times pero nasusuhulan lang yung mga nangraraid. And, papalit palit ng name ang company. When I checked sa SEC about its former names before Stratvisions, Webcom, Netpros, Versomina etc has different registrants and si JEA hindi nakapirma. Iba ibang address din ang nakalagay, like ang office address is sa Sta. Cruz when they operate sa Ortigas. Yung SEC employee mismo ang nagsabi the company is a scam….
Kaya please don’t shut the blog down…If you shut it down, mas marami pang lalabas jan. He cannot control the the rights of the people to express their feelings…I think its time to teach him that he cannot manipulate the people.

With those postings, I can only conclude these are coming from bitter employees. On the payslip matter, I don’t see anything wrong there since I’m working for a Fortune 500 company and we are given e-payslips. This is part of our company’s effort to go environment friendly.

But they did not even bother to pay my witholding tax. I confirmed it at the BIR Office. I tried to check my name and the company. Even calling the BIR hotline just to confirm this. I don’t exist in their database.
The blog helps a lot for those who are applying and for the fresh graduates seeking for their first job. The company has less employees as of now so the only way to make their company alive is to sue the AWOLs just like me. But I will fight for justice. I have a reason why I put at end in the company. For the people had the same situation just like me, win or lose, fight for your right.

I’ve read about article 285 where you don’t need to give notice to the employer if you are going to leave them due to reasons like inhuman and unbearable treatment and so on. That’s the reason I left that hell company.
I thought that they would stop bugging me. But I was wrong. They have proven me how greedy they are. I’m definitely shocked that they paid my contributions. I don’t know if they paid it the time I AWOL. But in my payslip, they are all zero.
Our government agencies doesn’t have any concern for the little ones so they don’t care if some of the employers like JEA paid late or doesn’t pay at all.
Now they have a reason that I need to pay them. If that happened, I’ll just pray to God and forgive these people who abused not only me but also their employees and former-employees and start to earn that large amount.
It’s a moral lesson for me that I shouldn’t become desperate of having a job.

You know, I believe the reason why the blogger opted to put up that blog is just to air his grievances. It was supposed to be personal but then other angry employees and ex-employees wanted to put their grievances too. I too, was a former employee of that Joel Aquino. He indeed is not a very good employer. If he only knows how to treat his employees well, none of these would happen. Also, we past employees do want to tell the rest of the country or the world for other IT people not to apply or get employed in that company because it’s a total waste of time. It would only be hell if they get into that company. It was just out of concern why we don’t want anyone to get into that company and also because we somehow want Joel Aquino to get karma or something for what he did and continually does. Please do not shut the blog down. You are just going to empower him and let him get away with all his wrong doings. If you are concerned of your fellowmen, then please do not shut the blog down. People deserves to be warned that there is such a company and that they should stay away from it. That’s all. Oh and thanks for the info. God bless!
